Mortgage After Debt Settlement

Question: Can a creditor put a lien against my house for a loan my ex took out if I have Quit Claim Deed?

I have a Quit Claim deed on my house, and prior to divorce, my husband took out a loan and secured it with the house. The loan was only in his name, but the house is in both. I was unaware of the loan and the house is mine as part of the settlement agreement and I have been told that I now have to pay on this “second mortgage” by the creditor.

But, I found out that the creditor has a judgment against my husband on this loan, not me and I am not a party to the judgment in any way except that the house is now legally mine. The judgment was done AFTER the Quit Claim deed was signed by him to me.

The question is: am I responsible for this debt since he signed the loan papers and the judgment is solely against him?

Answer: Did you record the QC deed with the county? That’s IMPORTANT.
Get expert legal advice ASAP. Go to your divorce attorney. . . .you may be able to have EX held in contempt of Court, ordered to take care of all this, even jailed.
Creditor cannot make you liable for the debt of EX, but if it is a valid lien against the house, you can’t sell it without clearing it up. So take care of this NOW.

Question: Mortgage debt forgiveness act?

My parents own a home and they owe about $20K in back mortgage payments. How does the mortgage debt forgiveness act will apply to them. They don’t want to loose their house.

Answer: Although some low level politicians have mentioned the possibility of mortgage debt forgiveness, I don’t believe anybody is seriously pushing the idea due to resistance from all the lenders. In other words, as far as I know, there is no such thing as a mortgage debt forgiveness act. There is a provision that says if you are foreclosed against or are granted a short sale, any debt you do not repay will not be considered income to you and taxes will not be levied on the debt forgiven. This occurs only after a foreclosure or short sale not before as I assume you were thinking about.

Question: How hard will it be to get a mortgage?

Here is the scenario:

A couple wants to buy a house. They do not have 5% to put down (expensive housing market). His credit is poor (in the 500’s) but he makes well-above average income and his only debt is his vehicle (bad money management in the past). Her credit is good, but her income is just average and she still has a good amount of debt (college loans, credit cards, vehicle).

When applying for a mortgage, would it be better to use the combined income ($100K+ per year) even though it would pull his low credit score, or is the credit score so important that they should try to just get the mortgage on her alone, even though she has a high debt to income ratio?

Will most companies agree to run both scenarios to see what the better deal is?

Answer: I think that most mortgage companies will look at both scenarios & take both incomes into consideration. If both people want to be on the note of the loan they will look at both incomes.

Question: Would a personal loan to pay credit card debt be better then a debt management program?

I have about 25000 of debt but can still pay montlhy payments on time and never missed a payment…if I try to get a personal loan from say lendingtree.com as opposed to a debt management program which looks better to creditors?? My beacon score is around 650-670….I am going to a credit counseling agency to see what they think….they are HUD approved and non-profit. I still have some assets stocks and bonds totaling 6000…I do get paid consistently and been trying some internet surveys to make some small money on the side to my job. What things should I look for at the credit counseling agency? Such as if they are legit or not in my situation?
