Texas Laws Debt Collection
Question: I sold a company in 2002 and told the vendor to change all accounts over to the new owners.?
In 2007, one of the vendors contacted me via their attorney that a debt to my old company name had gone unpaid and because I had signed a guaratee on the account in 1995 I was liable. I sent them documents showing the bill of sale, assumed name certificates of the new owners, a copy of the letter closing my account. I also requested the guarantee that I signed as well as their unpaid invoices, and other documents where they had sold equipment to the new owner (without my signature). Several months went by and they sent me nothing and filed a lawsuit against me in their home county 125 miles away. The debt is $4000 and any lawyer I spoke to said his fee would far exceed that amount to defend it. I believe this is their game, hope I will pay it rather than fight. If anyone knows business credit collection laws in Texas please advise me as to what sections of the statutes they are violating. I intend to defend myself in the courtroom and need all the help I can get.
ThanksAnswer: Do you have proof you told them to close the account? That should absolve you of any liability for the charges. Show up in court with those and you should be good.
Your problem? If you don’t have some sort of receipt or acknowledgment, they can always claim they didn’t receive the letter closing the account. In that case you might need all the paperwork you can muster, proof of the sale, perhaps other letters to other vendors WITH acknowledgment, anything at all that establishes that you were no longer involved with the company beyond 2002.

Question: is my mother in law responsible for credit card debt of deceased husband?
my father in law passed and has about 19,000 in unknown credit card debt.her name is on none of these cards and paying them would put her in a terrible financial situation.if it matters we live in georgia.thank you

of the death certificate along with a letter stating that your father in law
is deceased and that the estate does not have any funds to pay
the credit card debts.This letter needs to be sent via certifed mail
to all of the credit grantors.

Question: Debt Collection Laws in NC?
I have some delinquint medical bills from the last 3 years of cancer treatment. Its not really a huge amount, but I am still unable to work, and barely making it on disability. The hosp sold the debt to a local collection agency. The collection angency keeps calling and wanting me to pay off in full. I dont have that kind of money, so I keep asking to set up a payment plan at 20 per month. That is an amount that I can afford.
However, they keep telling me they wont accept a payment plan of anything less than 75 per month. THey will accept my money ofcourse, but wont set my up on payment plan.
I have heard that that is illegal. Is this true? Or is there someone that can tell me where to find the laws about this?

Debt Settlement State Laws

Question: what is law regarding intrest that can be added in debt collection on acct. in state of VA?
My husband and I have a Direct Merchants Account that was sold/transferred. Zenta limited is collecting this account I recently recieved our credit reports and the amount we have listed owed is a lot less than the amount they say we owe, (theirs is approx.4000.00 more ) 8970.00 been the same amount on credit report for 4 years, they are charging us over 200.00 per month in intrest even tho I worked out a settlement with someone in the company who said once we started paying on the account the intrest would stop. and now he is no longer to be found every time I call they say he is working a different shift. We still haven’t recieved a letter stating the settlement amout, I have talked with aleast 10 different peeps and get a different amout every time, we have been paying faithfully for over a year now, we were both injured in accident and have since both been perm disabled from the accident, anyone have any suggestions?
Answer: Dont make another payment until they put the agreement in writing.
Trust me, they will say one thing and do another.
