Question: Will I have to stop using all my credit cards if I enter a DMP through NFCC?

If I enter a “debt management plan” through the “national foundation of credit counseling,” will I have to stop using all my credit cards until I finish the “debt management plan?” What is their policy while being in a “debt management plan” with them? For example, say I have eight credit cards and five of them have balances that I am having trouble making the monthly payments on. The other three have never been used. Then I enter a “debt management plan” through the NFCC on the five cards that I am having trouble paying the monthly payments on. Will they require as part of the “debt management plan” that I not use the other three cards as long as I am in their “debt management plan.” Can they monitor me? Do I have to agree to never use any of three three cards as long as I am enrolled in their “debt management plan?”

Answer: I certainly hope they require you to not use any credit card. It pretty much defeats the whole purpose of a debt management plan if you are running up credit card balances on other cards.

Some NFCC programs will require you to close most of your credit cards.

Question: Debt Management Programme…..was referred to Payplan, a free service who advise people on?

how to solve their debts. At the moment, i pay back over £600 a month to my creditors, owe in total £30.000, i have opted for the debt management programme as i wish to pay all the money back, the company (which is completely free) worked out i can afford roughly £270 a month, which i would be able to afford. How likely is it that my creditors will agree to this? Seeing as they will get all their money back, albeit it over 9 years. Just want to know if they are likely to refuse or regect my offer? Thanks.

Answer: i’m with payplan and they have been fantastic. been with them for about 2 years now. we was paying £120 with a management company but payplan knocked this down to £40 a month. it’ll take lots of years to pay off our debt but we can’t afford to pay more as my husband is now disabled. all our creditors have accepted their payments. some have tried their luck every year to try to get more money from us but we just pass all correspondence to payplan to deal with. go with them as ease your finances and your worries. good luck to you

They are free. They are realistic in what a person needs to live on before they offer the remainder out to creditors. They check thoroghly that a person is fully liable for all the debts he has. They wipe off what they can and challenge who they want

They also have a wide database of charities and trust funds which they research to find any possible money that can be obtained to help pay some of a persons debts off.

Plus as they are specialists in the area and have been for a long long time… creditors are happy to deal with them on your behalf

Question: Help me please….Will I lose my home?

I have a mortgage that the fixed rate comes to an end on in May, I have had it for 3yrs. Due to the credit crisis at the moment our finances are really bad and we are currently on a debt management plan. We have never missed or even been late with our mortgage payments but what I am worried about is that in May, what if there isnt a company that is willing to give me a mortgage due to my credit rating?? Will it mean that we will have to sell the house? Or what if someone does offer us a rate but the payments are way too high ( struggling as it is!) and we have to sell anyway, this would mean that we wouldnt be able to reapply for another mortgage for 6yrs?? Am I best off declaring bankrupcy and get it over and done with- does that involve taking the house off us?? Sorry about the many questions but so confused!! HELP!!

Answer: I think the best way forward is to seek legal advise. There are specialist solicitors who offer free advise, look in your local evening paper for their address. Do not declare yourself bankrupt as this would certainly mean your home would be repossessed. Try not too worry, get the advise you need, speak also to your mortgage provider when your deal is coming to the end.

I was in a debt management program for several years. However, the company’s owners skipped town and thus payments were not made to creditors on time, etc…One Chase card reported three consecutive late payments in a row on my account and now this is having a HORRIBLE affect on my credit report. I’ve written to Chase to explain the situation (I’ve since paid off the account on my own and it has a $0 balance and is closed), however Chase responded that “to maintain the integrity of the credit bureaus, there was nothing they could/would do…” Any suggestions for getting this off my credit report – it wasn’t my fault and the New York Attorney General’s office was involved with the fraud at the Debt Management Program: [Cambridge Birghton Budget Management Group]…Thanks!

Answer: It depends if it is a Debt Management Program(Credit Counseling) or a Debt Settlement Company. As well as the attitude of the judge, some judges are really consumer friendly, others are really creditor friendly.

If you are with either type, it won’t effect if you owe the debt or not. That is if you owe the debt you are still going to get a judgment against you. However, how willing the court is to work with you will matter on the type of program you are on.

If you are in a DMP and making payments to the DMP in a timely manner. The judge may feel that you are showing “good faith” and make your payments to them equivalent to what they would be in the DMP.

However, if you are in a Debt Settlement Program. This is a program where they actually have you stop paying your creditors in the hopes to get them to settle for a small fraction. The judge may give you a nice 30 minute lecture and then allow them to take further action such as attaching your wages or bank accounts(if your state allows either of these).

Either way SHOW UP for court, because it would be far worse to not show up at all.
