Question: Debt collection?
My nephew bought a computer from Dell and used my mother for a reference. My mother was called and interviewed. She is elderly and does not remember all the details of the conversation. My nephew did not make payments. Dell has sold the account to Oxford Management services. OMS is now calling my mother demanding payment. She was told that they can freeze her savings account in order to collect the debt. She did not co-sign and no personal information was given to the company except for phone number and address. Is this legal? What are her options?
Answer: This collection agency violated at least 2 laws of the Fair Debt Collection Practice Act.
1. Disclosure of the matter to a 3rd party.
2. Misrepresenting the legal status of a debt, which they actually did twice by trying to collect from someone not legally obligated to pay and then by threatening to freeze her bank account, which can only be done with a court order.If you could prove this happened, your mother could easily sue Oxford for those violations. In my opinion, you have two ways you can handle this.
A) Find out what the laws are in your state regarding phone calls, and if possible record them making these type of threats and then file suit against oxford. Try NACA.net for a consumer lawyer, as they will usually take the case on a contingency.
B) Send Oxford a cease and desist letter telling them to stop ALL contact with your mother on this matter, which by law they have to abide by or you can sue them for that as well.
