Question: What is worse for my credit? Debt Counseling or Bankruptcy?

I have finished debt counseling now I am hearing reports that I was probably better off filing for bankruptcy. Any advice?

Answer: I have done both. I first tried Debt. counceling and consolidation. All it did was make my credit worse. The company only paid the minimum balance if that and creditors still hounded me daily. Once I filed for Bk they were not aloud to contact me again. My credit has actually improved since my bk was final and I was able to purchase a vehicle and a low balance credit card. I am able to purchase a home but at a crazy high interest rate. It has been almost a year and a half since the bk was final and my credit is better than it has been in years. I recommend that if you are choosing one go with the bk, it gives you a fresh start. Just remember that it does stay on your record for eight years and you can not file again for eight years depending on which chapter you file under.

i had about $18,000 debt, and by listening to my brother i went in to debt consolidation. didnt know that it can really mess up my credit score. before i went in to credit counseling my score was 700+, but dont know how much it is now. anywayz i was in credit counseling for about 1 year, and then finally paid off the full debt with in 1 year, rather than staying in the program for 3 years. now i want to buy a house. i took my account out of credit counseling/debt consolidation about 4 months ago. i know want to buy a house. would i qualify for a home loan? where can i go to get my credit score? what kind of downpayment should i be expecting and what would be my interest rate?? any help in this matter will be greatly appreciated! thanks!

well heres the thing im 20 years old and im $15,000 in debt. I have a couple of accounts in collections if not all now and i need help. Just had a major surgery and racked up some major credit card debt while being out of work. Just looking to see where I could start now that I am going back to work.

Answer: If you are able, take out a home equity loan. Pay off the credit card bills with the proceeds. Then pay off the home equity loan as quickly as possible. This is a win-win situation. You get the credit card bills paid off, plus the interest on the home equity loan is a tax deduction.

Or, you could line up the credit card bills by 1)interest rate, 2)highest amount owed to lowest amount owed, or 3)lowest amount owed to highest amount owed. Whatever way you line them up, start paying them off.
I preferred the lowest amount owed to the highest amount owed. I paid the most money to the lowest balance, then paid the remaining bills just above the minimum required. As the lowest bill was paid off, I then applied that same amount plus the minimum to the next highest bill. As that bill was paid off, I then applied that amount plus the minimum to the next bill, etc.
Now Susie Orman would disagree with this method, but I found great satisfaction in seeing the bills disappear more quickly than if I had paid off the highest interest rate bill (regardless of balance) or the highest balance bill first. Plus, I think when you have big bills hanging over your head, you need to see progress as quickly as possible. It really gives you a boost to see those bills drop off the face of the earth.

Answer: yea, but you can do that too.
what they do is not pay your creditors for months and then try to get them to settle for less. If thats the route you have to take then just do it yourself and save the fees they charge and put it on the debt.

Remember that if you go with some company to do this for you and they dont pay your creditors then you are still responsible for the debt not the company that is handling it for you. Your creditors will sue you not them.

Chapter 7 and Chapter 13 are the two personal bankruptcy choices available to individuals. Chapter 7 is about liquidation of assets. It gives immediate relief of debts. The trustee liquidates the assets and repays the creditors. The property for which the debtor has a right is not liquidated. There is little or no nonexempt property under Chapter 7 bankruptcy cases.

Another option is Chapter 13 bankruptcy. There is no immediate discharge of debts in this type of bankruptcy. This is filed by persons who have a regular income. The debtor promises to repay the debts over three to five years. The debtor can keep his or her properties. In both cases, the creditors are not allowed to initiate any action against the debtor. Although no immediate discharges are available, this plan covers more debts than Chapter 7 personal bankruptcy does. At the end of the three to five year repayment plan period, the remaining unsecured debts are discharged.

The payments are made through the trustee. However, creditors can challenge the bankruptcy filing at court.

Before Filing Personal Bankruptcy

There are several provisions in effect prevent abuse of bankruptcy laws. People planning to file bankruptcy suits must first get credit counseling. Only government approved organizations can offer such counseling.

The pre-bankruptcy counseling involves appraisal of individual financial situation, exploration of alternatives to bankruptcy, and preparation of a practical personal budget plan. The organization is legally required to provide free counseling, if the individual can’t pay for the services. The fee is around $50. You will also receive a certificate of completion of counseling.

There is also a debtor education session, which lasts for about two hours. Your bankruptcy plea won’t be accepted unless you furnish the certificates.

About The Credit Counselor

Certificates from government approved counselors are needed for filing personal bankruptcy suits. You must take into consideration the kind of services on offer.
